COACHING AGREEMENT, INFORMED CONSENT & PRIVACY NOTICE

Effective September 23, 2026 • Version 2026-09-23

1. Service and term

The program provides individualized exercise programming, general nutrition and wellness education, habit and accountability support, progress reviews, direct messaging and coaching calls during the purchased coaching term. Coaching is educational and collaborative. It does not create a clinician-patient relationship.

2. Scope and professional boundaries

Total Recreation does not diagnose, treat, cure or prevent disease; prescribe medication; interpret laboratory testing; rehabilitate injury; provide psychotherapy; or provide medical nutrition therapy. Nutrition support is limited to general wellness education, meal structure, calories, macronutrients and behavior support for otherwise healthy adults. A client seeking help to manage or treat a medical condition will be referred to an appropriately licensed professional.

3. Eligibility and health clearance

Clients must be at least 18 years old. Before beginning, the client must disclose known medical conditions, injuries, symptoms, medications, allergies, pregnancy, eating-disorder history and other limitations that could affect exercise or nutrition. The client agrees to obtain clearance from a qualified healthcare professional when any such circumstance exists or when there is uncertainty about safe participation. Total Recreation may pause or decline coaching when licensed care is more appropriate.

4. Voluntary participation and risk

Exercise and changes to physical activity carry inherent risks, including soreness, strains, sprains, falls, fainting, cardiovascular events and other serious injury. The client voluntarily chooses to participate, controls their environment and equipment, uses reasonable judgment, follows safety instructions and stops immediately upon pain, dizziness, chest discomfort, unusual shortness of breath or other concerning symptoms. The client should call 911 for an emergency.

5. Client responsibilities

The client is responsible for accurate disclosures, safe exercise execution, obtaining suitable equipment and facilities, keeping scheduled appointments, communicating concerns promptly and deciding whether to implement any suggestion. The client will not share portal credentials or proprietary materials. Coaching does not provide continuous supervision or emergency monitoring.

6. Results and testimonials

Results depend on individual starting point, health, adherence, sleep, stress and other factors. No outcome, amount of weight change, physique result, income result or timeline is promised. Client photographs, messages, name or testimonial will not be used publicly without a separate, optional written release.

7. Fees, fixed term and early departure

The client commits to the purchased 3, 6 or 12 month coaching term and the total price and payment schedule disclosed before checkout. Choosing to stop participating early does not cancel the agreed payment obligation or create a refund right. Total Recreation charges no separate cancellation or early termination fee. Any exception stated in the written enrollment terms or required by applicable law still applies. If the client uses a third-party financing provider, that provider's repayment agreement is separate and remains subject to its own terms. Missed calls and late call cancellations may be forfeited when stated in the enrollment terms, except where applicable law requires otherwise.

8. Privacy and communications

Total Recreation collects contact details, intake responses, health-related disclosures, progress data, check-ins, communications and agreement records to deliver and administer coaching. Access is limited to people and service providers reasonably necessary to operate the program. Information may also be retained or disclosed when required by law, to protect safety or enforce an agreement. Online systems and electronic messages carry security risks; clients should avoid sending information they do not want stored electronically. Total Recreation is a coaching service and does not represent that it is a HIPAA-covered healthcare provider.

9. Intellectual property

Plans, templates, videos, worksheets and other program materials are licensed to the enrolled client for personal, noncommercial use during and after the program. They may not be resold, published, copied for others or used to coach another person.

10. Electronic acceptance and severability

Typing a legal name and selecting the required acceptance box constitutes an electronic signature. The recorded agreement version and acceptance time identify the terms accepted. If a provision is held unenforceable, the remaining provisions continue to the fullest extent permitted by law. No informal message changes this agreement unless both parties clearly agree in writing.

11. Questions and professional advice

Questions about coaching should be raised before acceptance. Clients should consult qualified medical, nutritional, mental-health, tax, financial or legal professionals for matters within those licensed fields. This document is intended to establish informed expectations; it is not a substitute for state-specific legal advice to either party.
